Terms of Service
These Terms of Service (“Terms”) shall govern your use of the Preschoolearn.com website (“the Website”) and the subscription to digital educational materials (“the Service”). Please read these Terms carefully before accessing or using the Website and subscribing to the Service. By accessing or using the Website and subscribing to the Service, you agree to be bound by these Terms.
The Preschoolearn.com website available at https://preschoolarn.com is run by Katarzyna Woźniczko-Kajda conducting business activity registered in Poland under the name Katarzyna Woźniczko-Kajda, entered into the Central Register and Information on Economic Activity (CEIDG) kept by the minister competent for economy, NIP PL6372084605, REGON 384796263.
- Acceptance of Terms
- By using the Website and subscribing to the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any of these Terms, you must not use the Website or subscribe to the Service.
- General Information
- The Seller, to the fullest extent permitted by law, shall not be responsible for disruptions, including interruptions in the functioning of the Store caused by force majeure, unauthorized actions of third parties, or incompatibility of the online Store with the Customer’s technical infrastructure.
- Placement of orders for the Services available in the Store is possible after creating an Account in accordance with the provisions of (4) of these Terms of Service.
- All prices on the Website are in Euro (EUR). Prices might be converted to the customer’s currency by 3rd party payment service. The prices displayed on the store’s website may not include tax. Tax will be automatically added upon entering the 3rd party payment service. If the buyer is or is not obligated to pay the tax (for example, his residence is outside of the EU, but the value added tax (VAT) is added) and the tax has not been calculated correctly, he/she shall contact the Seller before placing the Order in order to apply the correct VAT amount or to check the Seller’s eligibility to sell to the Customer’s country.
- The final amount payable by the Customer consists of the price for the Service for the specified period, of which the Customer is informed about on the store or 3rd party payment service during the order placement, including at the time of expressing the intention to enter into Sales Agreement.
- The Customer shall have the possibility to use the portal’s services in a limited free manner by choosing the Free Plan. Within the Free Plan, the user shall not have access to paid content.
- Users of Paid Scenarios plans shall have access to service content assigned to the paid plan as well as free content.
- Subscription and Access
- 3.1 Subscription
- By subscribing to the Service, you gain access to the digital educational materials offered on the Website for the duration of your subscription period. The subscription is personal, non-transferable, and subject to the terms and conditions outlined in these Terms.
- 3.2 User Account
- In order to access the Service, you may be required to create a user account. You agree to provide accurate and complete information while creating your account and to keep your login credentials confidential. You shall be solely responsible for all activities that occur on your account.
- 3.3 Subscription Fees
- The subscription to the Service may require payment of fees. By subscribing, you agree to pay applicable fees as stated on the website or payment service. All fees are non-refundable unless otherwise stated in the Refund Policy.
- 3.1 Subscription
- Creating an Account in the Store
- To create an Account in the Store, you need to fill out the Registration Form. The following data must be provided: active email address, and password that meets security requirements.
- Account activation is carried out by clicking the activation link in the email received at the email address provided during registration.
- Creating an Account in the Store is free of charge.
- Logging into the Account is done by providing the login and password established in the Registration Form.
- The Customer shall have the possibility to delete the Account at any time, without giving a reason and without incurring any fees by sending a relevant request to the Seller, in particular via email or in writing to the addresses provided in the contact information.
- In the case of creating an account for multiple persons simultaneously, the buyer should choose the option of creating an account for multiple persons in the Store or contact the Seller if the option is not available on the Store’s website at the time of creating the account.
- Rules of Order Placement
- The website and service use an external payment processor. The payment processor is Stripe, Inc., and PayPal (Europe) S.à r.l. et Cie, S.C.A. After selecting a plan on the website, the user is redirected to the selected payment processor’s page. This is the only available payment method on the website. The payment process is subject to their own Terms of Service.

- The Website and Service are intended for individuals who are 18 years of age or older. If you are under 18, you may only use the Website and subscribe to the Service with the involvement and consent of a parent or guardian. By using the Website and subscribing to the Service, you confirm that you meet these age requirements.

- Satisfaction warranty does not cover any damage or loss resulting from misuse, unauthorized sharing of account credentials, or violation of these Terms. Preschoolearn.com reserves the right to determine, at its sole discretion, whether a claim qualifies for the satisfaction warranty.

- Limitation of Liability
- To the fullest extent permitted by applicable law, Preschoolearn.com (Katarzyna Woźniczko-Kajda) and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses arising out of or in connection with your use of the Website or Service.

- Preschoolearn.com (Katarzyna Woźniczko-Kajda) reserves the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on the Website. Your continued use of the Website or Service after the posting of any changes constitutes your acceptance of such changes.
- Governing Law and Jurisdiction
- These Terms shall be governed by and construed in accordance with the laws of Poland. Any legal actions or proceedings arising out of or relating to these Terms shall be exclusively brought in the courts of Poland.
- Severability
- If any provision of these Terms is found to be invalid or unenforceable, such provision shall be severed from the Terms without affecting the validity or enforceability of remaining provisions.
- Subscription details
- After paying for access to the service, the customer shall receive an electronic access to the paid materials. Materials are not sent to the customer. The customers can access the materials available on the website as long as their subscription is active.

- Sales agreement
- The conclusion of a Sales Agreement between the Customer and the Seller occurs after the Customer submits an Order using the Order Form on the Online Store and successfully makes a payment on the payment operator’s website. After placing an Order and successful completion of the payment, the Seller shall immediately confirm its receipt. The confirmation of receiving an Order and its execution is sent to the Customer via an appropriate email message to the email address provided by the Customer during the Order/Registration process. Sales Agreement between the Customer and the Seller is concluded upon the Customer’s receipt of the aforementioned email message.
- Access to the service is granted immediately upon the Seller receiving payment confirmation from the payment service provider (Stripe Inc. or PayPal (Europe) S.à r.l. et Cie, S.C.A.).
- The Customer is granted access for the duration of an active subscription. The subscription is automatically renewed.
- The Customer can cancel the subscription at any time – cancellation will result in no charges for the next period. Canceling a paid plan before its expiration does not exempt the Customer from payment for the entire plan duration. If the Customers switch from one paid plan to another or a free plan, they shall lose access to the previous plan and should contact us by an e-mail to restore his previous plan.
- The Seller reserves the right to make changes to the plans (duration, fees, scope of materials). Changes to the plans do not apply to plans already purchased until the end of the respective plan’s validity period. A detailed and up-to-date description of individual plans is available on the Seller’s website.
- The purchase of paid scenarios for a larger group of people is possible after meeting the purchasing conditions for a group of individuals; otherwise, the buyer is obliged to make a separate purchase for each person in the group.

- a. change the account user (transferring registered accounts is not allowed without the seller’s consent),
- b. share the account with other individuals,
- c. use multiple accounts contrary to the rules,
- d. sell purchased content or sell content from the subscription,
- e. sell free content from the website,
- f. share purchased content with others,
- g. share purchased content on other websites, social media platforms, etc. (excluding materials marked as free or direct links to the seller’s website),
- h. use a single account for more than one person (excluding special and group accounts),
- i. share free materials on other websites, social media platforms, etc., without indicating the source of the materials,
- j. charge for sharing free or paid content,
- k. modify shared free content without the seller’s consent,
- l. use, modify, or share graphics found on the seller’s website without the seller’s consent.
- 17.2 The Seller reserves the right to suspend access to an account in the following cases:
- a. change of the account user (transferring registered accounts is not allowed),
- b. sharing the account with other individuals,
- c. repeated, unfinished purchases,
- d. using multiple accounts contrary to the rules,
- e. repeated violations of the Terms of Service, despite prior warning and notice,
- f. selling purchased content or selling content from subscription,
- g. selling free content from the website,
- h. sharing purchased content (or content from subscription) with others,
- i. sharing purchased content (or content from subscription) on other websites, social media platforms, etc. (excluding materials marked as free or direct links to the seller’s website),
- j. death of the account owner,
- k. using a single account for more than one person (excluding special and group accounts).
- 17.1 It is prohibited to:
- Complaint
- In the event of a defect in the purchased Service from the Seller, the Customer shall have the right to file a complaint based on the provisions of Polish law.
- The complaint should be submitted in writing or by e-mail to the Seller’s addresses provided in these Terms and Conditions.
- It is recommended to include in the complaint a concise description of the defect, circumstances (including the date) of its occurrence, the Customer’s details submitting the complaint, and the Customer’s request regarding the defect of the service.
- The Seller must respond to the complaint request immediately upon receipt of a written complaint, no later than within 14 days, and if the response is not provided within this period, it is considered that the Seller has deemed the Customer’s request as justified.
- Out-of-court methods of complaint resolution and settlement of claims
- The customer shall have the right to use out-of-court complaint resolution methods and pursue claims. For this purpose, they may file a complaint through the European Union’s online dispute resolution platform (ODR) available at: http://ec.europa.eu/consumers/odr/.

- Consumer – a natural person concluding a contract with the Seller as a part of the Store, the subject of which is not directly related to his/her business or professional activity.
- Seller – a natural person conducting business activity under the name Katarzyna Woźniczko-Kajda, entered into the Central Register and Information on Economic Activity (CEIDG) kept by the minister competent for the economy, NIP PL6372084605, REGON 384796263.
- Customer – any entity making purchases in the Store.
- Store – an online Service run by the Seller at https://preschoolearn.com
- Regulations – these regulations of the Store.
- Order – the Customer’s declaration of will submitted with the use of the Order Form and aimed directly at concluding a Product or Products Sales Agreement with the Seller.
- Account – the customer’s account in the Store, it collects data provided by the Customer and information about the Orders placed by him in the Store.
- Registration form – a form available in the Store, allowing you to create an Account.
- Order form – an interactive form available in the Store that allows you to place an Order, in particular by selecting an access plan to paid materials, choosing the time of access to materials, and the amount of the fee.
- Paid scenarios – a service available in the Store to access digital content that is the subject of the Sales Agreement between the Customer and the Seller.
- Sales Agreement – a Product sales agreement concluded or concluded between the Customer and the Seller via the Online Store. Sales Agreement is also understood as – applying to the characteristics of the Product – a contract for the provision of services.
- Free plan – a service available in the Store that is not the subject of the Sales Agreement between the Customer and the Seller, enabling the user free of charge, but limited access to the Website.
- Materials for classes – teaching aids, e.g. picture cards, work cards.
- Payment Service – subscription and products payment processor (Stripe Inc. or PayPal (Europe) S.à r.l. et Cie, S.C.A.)
- Content – all texts, pictures, and files available on the website
